Which of the following processes is the most adversarial?

Show Suggested Answer Hide Answer
Suggested Answer: C

The correct answer is: 'damages attempt to position the innocent party in the position that they would have been had the contract been performed as expected'. This is a quote from p. 121 Option1 is incorrect as unliquidated damages aren't stated in a contract. Option 2 is incorrect because liquidated damages are an assessment of damages before a breach. Option 4 is incorrect because not all breaches are caused by errors (they can be caused by negligence or the offending party withholding something).

Wait, are we sure litigation is the most? Seems like a stretch.

I thought mediation was supposed to be the least adversarial, but I can't remember if adjudication is more or less adversarial than that.

I practiced a question like this before, and I chose litigation then. It just seems to fit the definition of adversarial best.

I'm not so sure... I remember something about adjudication being pretty adversarial too, but maybe not as much as litigation?

I think litigation is the most adversarial because it involves going to court and fighting against each other, right?

Adjudication is the most formal and structured process, so I'm guessing that would be considered the most adversarial. I'll mark that one.

Mediation seems like the least adversarial since the parties work together with a neutral third party to find a resolution. I'll go with that.

I'm pretty confident that litigation is the most adversarial of these options. The parties are in an adversarial position throughout the legal proceedings.

Hmm, this is a tough one. I'm gonna go with litigation though - it's like a legal version of 'Mortal Kombat' if you ask me.

I think adjudication can also be pretty adversarial, with a third party making the final decision.

Adjudication sounds so formal and intimidating. I'd rather go with the negotiation route - it's more like a game of chess, you know?

I disagree, I believe adjudication can be more adversarial because it involves a third party making a binding decision.
