Show Suggested Answer Hide Answer
Suggested Answer: C

Express terms are the terms of the agreement which are expressly agreed between the parties. Ideally, they will be written down in a contract between the parties but where the contract is agreed verbally, they will be the terms discussed and agreed between the parties.

The types of express terms to be found in a contract are many and varied and will depend on the type of contract. Any term written into the contract is an express term and may refer to price, time scales, warranties and indemnities, limitations on liability, conditions precedent and so on.

I believe the two not covered are contract validity and liability for personal injury, based on similar practice questions we did.

I feel like liability for personal injury might not be covered, but I can't recall if transfer of risks is included or not.

I remember discussing remedies for breach of contracts in class, so I don't think that's one of the exceptions.

Ah, the CISG - I remember learning about this. I believe it doesn't cover contract validity and remedies for breach of contracts, so I'll select those.

Okay, let me see. The CISG is about the international sale of goods, so it probably doesn't cover things like transfer of risks or liability to pay damages. I'll go with those.

Hmm, I'm a bit unsure about this. I know the CISG covers a lot, but I can't quite remember what it doesn't cover. I'll have to think this through carefully.

I think I know this one! The CISG doesn't cover contract validity and liability for death or personal injury, so I'll select those.

Ooh, tricky one! I bet the answer is B and E. The CISG is focused on the sales transaction, not the overall contract or damages.

I'm going with B and D. The CISG is all about the sales contract itself, not the broader validity issues or personal injury claims.

Haha, I'm pretty sure the CISG doesn't handle seller liability for death. That's a bit dark for a commercial law convention, don't you think?

I think B and E are not covered by CISG. Contract validity and liability to pay damages seem to be excluded from the Convention's scope.

A and D? The CISG covers transfer of risks and liability for personal injury, so those can't be the correct answers.
