I've got a good feeling about "Forbearance" as the answer. The question is describing a situation where a party is intentionally not enforcing a contract, which seems to fit that legal concept.
I'm a bit confused by the wording here. "International failure" - does that mean this is related to international law? I'll have to think about that angle.
