How does the GDPR relate to cookies?

Show Suggested Answer Hide Answer
Suggested Answer: D

Information society services (ISS) are defined in Article 4(25) of the UK GDPR as ''any service normally provided for remuneration, at a distance, by electronic means and at the individual request of a recipient of services''. This means that ISS are online services that are paid for, either by the user or by another source of income, such as advertising or sponsorship, and that are provided without the parties being physically present, using electronic equipment for the transmission and reception of data, and upon the request of the user. Examples of ISS include apps, programs, websites, search engines, social media platforms, online marketplaces, content streaming services, online games, and any other online services that offer goods or services to users over the internet. Therefore, options A, B and C are correct examples of ISS, as they meet the criteria of the definition. However, option D is not a correct example of ISS, as it does not involve any remuneration for the service provider. Information services provided by non-profit or government organisations with no remuneration are not considered ISS under the UK GDPR, unless they compete with other ISS on the market.Reference:

Nope, GDPR applies to all cookie usage, not just personal data!

Wait, so websites only need opt-out if GDPR applies? Sounds confusing.

I feel like I read that websites need to provide an opt-out option for cookies, but only if GDPR is relevant. That seems a bit confusing!

I practiced a question similar to this, and I think the GDPR applies whenever cookies are used, but I could be mixing it up.

I’m not entirely sure, but I think there was something about PECR and how it interacts with GDPR. Maybe it’s only PECR that applies in some cases?

I remember that the GDPR is all about protecting personal data, so I think it might only apply when cookies process personal data.

Okay, I've got a strategy for this. The GDPR applies to personal data, so I need to figure out if cookies are always processing personal data. That will help me determine which option is correct.

Hmm, this one's a bit tricky. I know the GDPR has some requirements around cookies, but I'm not totally sure of the details. I'll need to think through the different options carefully.

I think the key here is understanding the relationship between the GDPR and PECR. The GDPR applies more broadly, while PECR specifically deals with cookies, so I'll need to consider how they interact.

I'm feeling pretty confident about this one. The GDPR does apply to cookies, but the specific requirements depend on whether the cookie is processing personal data or not. I think option A is the right answer.

Okay, I know Cisco SD-WAN uses BFD for fast failure detection, so that's got to be the right answer here. I'm confident that's the key data plane resiliency feature.

I'm leaning towards option C. Doesn't PECR take precedence over GDPR when it comes to cookies?

So it's important to consider both regulations when dealing with cookies on a website.
